Can a passenger in a vehicle be charge with “Fleeing to Elude”? I live in the State of GA.?
I have a friend whom is 18 years old. A year ago, she was riding with a boy who did not have a license. They were caught in a roadblock and they panicked and got out and ran. She has never had a license up until two months ago. The PD charged her with “Fleeing to Elude” and has put this charge on her license record. Now, she is trying to get car insurance and the prices she is quoted are astronomical and they said it is because of the Major charge on her driving record which will be there for five years. She has a new baby (which is my grandbaby) and she needs to be able to get insurance to get around. I have been told by more than one person that they cannot do this and that she should have been given with a misdemeanor obstruction charge instead. The funny thing is she was never put on probation for anything.
Given the circumstances as you state them above, I would say that fleeing to elude would be the appropriate charge. When you are ordered to stand still and you run from the Police, fleeing would be more appropriate over an obstruction charge.
This is now in the past and you cant change that aspect. One thing your friend CAN do is contact an attorney within the jurisdiction of the citation and see about an expungement of the record. The attorney will have to get a copy of the citation for the specifics, but he will then know whether she would qualify. If so, the cost of the expungement will be far less then the cost of the insurance over the next five years.
