Can a person be found guilty of a crime when somebody else admits to it?

My sister and I look much alike. My license is suspended right now. My friend was driving my sisters car to take me somewhere (I was in the passenger seat). The police pulled us over and little did I know, my dad forgot to pay the car insurance. The police officer cited me for driving without a license, and driving without financial stability. He said he saw me driving earlier in the day. My sister admitted that she was the one driving. Unless you’ve known us for years you cannot tell us apart. I was not driving and the car is not in my name yet I was fond guilty for both. I’m confused.

I think you answered your own question – yes it can happen if it happened to you. As far as what you can do about it, get a lawyer – they know all the ins and outs of the legal system and it is their job to create reasonable doubt. I’m sure they could find a way to arrange for the cop to identify you in a line-up with your sister.

Unless you have not given us all the particulars of the case, I’m fairly certain the officer cannot cite you for something that happened hours earlier, especially when he did not stop you at that time. Again, consult a lawyer, and if you haven’t already done so, contact his superiors and tell them that he gave you the citation based upon assumption (that you were the person he saw driving – he did not stop “you” at the time he saw it nor was he aware that your license was revoked). I briefly studied constitutional law as part of my degree program and I’m 98% sure there is something about that which violates the fourth amendment, but I can’t put my finger on it. Definitely consult a lawyer.

My son is fine, just a little scraped up. The people who owned the car followed my son home and asked to speak with me. They showed me the damage on their car and asked for my name and number and they gave me theirs. I’m not sure where to go from here. I was so panic striken in the moment I didn’t think to call the police and I don’t think my car insurance will cover the damage beings as it was my kid that hit their car, not my vehicle. Your car insurance has nothing to do with it. Your home owners or renters insurance will cover it. If there is a deductible or you have no insurance you are responsible for the amount. The other party can contact their insurance company but if the insurance company believes it was your son’s fault they will come after you for payment.

Do not admit any liability. Let the insurance companies handle it.

my mother’s car is in both our names, i’m making payments,she has insurance in her name. am i liable?

i bought and am making payments on a car for my mother. both our names are on the title. she has car insurance in her name. am i liable if she has a wreak. can whoever she hits sue me? we live in south texas, we travel in this car some to oklahoma.

first of all, if your name is on the title, BOTH of u should be on the insurance as named insureds. if you’re not driving the car, u dont have to be listed as a driver, but since you are part owner of the car, you DO have an insurable interest in the car. in other words, if the car is totalled, right now the check will only go to your mom & the bank, not you.
second, even though your mom would be the driver, if the claim exceeds the limit of liability she carries, yes, you can be sued f/ the remainder as it is your car too. maybe it’s not fair but YOU are responsible f/ anything you own and/or co-own, no matter what the situation is.
therefore, you need to be put on the insurance and then u can make decisions about what limits of liability are on the car. keeping in mind that you not only need to protect your mother’s assets but yours as well, b/c an attorny will go after anything and everything that he legally can.

Do I need to wait for my current insurance policy to expire before I go with a new company?

I want to switch to a different insurance company for my cars & house (currently with State Farm) but I have a while until my current policy is up for renewal/expiration. Can I cancel my current State Farm policy at any time without paying any type of fee? I am waiting to hear back from them on a different issue, so I will ask later, but figure I will ask Yahoo! in the meantime.

It depends on your state. Some states do not allow a cancellation penalty.

I recommend calling State Farm’s customer service toll-free number. I have tried having people call their current agent, but sadly, the results were mixed. Some agents know their policies well, but others just assume there must be a penalty without really checking it. That’s why I ask them to call their company’s customer service department instead of their agent.

If they are in my office at the time, I make the call for them, hand them the phone to verify their identity and give consent for the customer service rep to answer to me, and then I ask the questions for them. If you’re uncertain what to ask the company, then ask your new agent if he or she will help you with this.

The result is that I have some people switch to my agency immediately and cancel their old policies; and I have others wait until renewal.

What will be less on car insurance V6 Or 4 cylinder?

I know i should just call and get a quote. Not even sure if i can since i only have a permit, but will be going for my lincense on monday. So advice on if you think they can still give me a quote would be great.
