Can a person be found guilty of a crime when somebody else admits to it?
My sister and I look much alike. My license is suspended right now. My friend was driving my sisters car to take me somewhere (I was in the passenger seat). The police pulled us over and little did I know, my dad forgot to pay the car insurance. The police officer cited me for driving without a license, and driving without financial stability. He said he saw me driving earlier in the day. My sister admitted that she was the one driving. Unless you’ve known us for years you cannot tell us apart. I was not driving and the car is not in my name yet I was fond guilty for both. I’m confused.
I think you answered your own question – yes it can happen if it happened to you. As far as what you can do about it, get a lawyer – they know all the ins and outs of the legal system and it is their job to create reasonable doubt. I’m sure they could find a way to arrange for the cop to identify you in a line-up with your sister.
Unless you have not given us all the particulars of the case, I’m fairly certain the officer cannot cite you for something that happened hours earlier, especially when he did not stop you at that time. Again, consult a lawyer, and if you haven’t already done so, contact his superiors and tell them that he gave you the citation based upon assumption (that you were the person he saw driving – he did not stop “you” at the time he saw it nor was he aware that your license was revoked). I briefly studied constitutional law as part of my degree program and I’m 98% sure there is something about that which violates the fourth amendment, but I can’t put my finger on it. Definitely consult a lawyer.
